Analisis Akta Keselamatan dan Kesihatan Pekerjaan (Pindaan) 2022 Perbandingan Sebelum dan Selepas Pindaan serta Implikasinya Terhadap Industri
Abstract
The latest amendments to the Occupational Safety and Health Act (OSHA) in 2022 are designed to strengthen existing provisions for worker safety and health, addressing new challenges in modern industries and ensuring the Act remains relevant. A thorough analysis of these amendments is essential for understanding their impact on workplace safety practices, the development of more effective safety strategies, and ensuring compliance with the updated regulations. By examining the background and context of the amendments, this analysis offers valuable insights into the emerging challenges and opportunities in enhancing safety and health standards for all workers in Malaysia. One significant change brought by the 2022 amendments is the repeal of the Factories and Machinery Act 1967 (FMA 1967), effectively creating a unified piece of legislation governing occupational safety and health in Malaysia. This research uses a qualitative approach, focusing on a critical analysis of the legislation before and after the 2022 amendments. The study finds that the consolidation of FMA and OSHA into a single legislation has successfully reduced the problem of overlapping enforcement between the FMA 1967 and the OSHA 1994 when both were in force. This represents a key step in streamlining safety regulations and improving the overall enforcement framework in Malaysia.

Pindaan terbaru dalam Akta Keselamatan dan Kesihatan Pekerjaan (AKKP) pada tahun 2022 bertujuan untuk memperkuat peruntukan-peruntukan keselamatan dan kesihatan pekerjaan (KKP), mengambil kira perkembangan baharu berkaitan KKP serta memastikan AKKP sentiasa relevan dalam keperluan industri moden. Analisis terperinci terhadap implikasi pindaan ini menjadi penting untuk memahami bagaimana perubahan tersebut akan mempengaruhi amalan keselamatan dan kesihatan di tempat kerja, membentuk strategi keselamatan yang lebih berkesan, dan memastikan kepatuhan terhadap undang-undang yang diperbaharui. Dengan pemahaman yang jelas tentang latar belakang pindaan terbaru dalam AKKP, analisis ini memberikan pandangan menyeluruh tentang cabaran dan peluang baharu dalam meningkatkan KKP di tempat kerja, serta langkah utama dalam mencapai sasaran keselamatan dan kesihatan yang lebih baik bagi semua pekerja di negara ini. Perubahan penting yang berlaku kerana pindaan AKKP 2022 ialah pemansuhan Akta Kilang dan Jentera 1967 (AKJ 1967) yang mewujudkan perundangan tunggal berhubung KKP di Malaysia. Kajian ini menggunakan kaedah kualitatif dan analisis kritikal berhubung keadaan perundangan tersebut sebelum dan selepas pindaan 2022. Kajian mendapati pengwujudan perundangan tunggal dapat mengurangkan permasalahan pertindihan penguatkuasaan dalam peruntukan AKJ 1967 dan AKKP 1994 semasa kedua-dua Akta tersebut dikuatkuasakan. Ini merupakan langkah utama dalam menyeragamkan peraturan keselamatan dan menambah-baik kerangka pematuhan secara menyeluruh di Malaysia.
