[ms] Marriage Termination by Khuluk and Its Effects on the Period of Idah

Abstract

A type of the termination of marriage in Islam is known as khuluk. The muslim jurists however differ in determining the nature of khuluk whether it is talak or fasakh. Their differences of opinions then gave an effect on idah period for divorced women. This article attempts to present the relevant Qur’anic verses, the Traditions of the Prophet and the opinions of Muslim jurists regarding the khuluk and its relation to the period of iddah. This discussion will includes some observations of reported cases in the Syariah Court in Malaysia.
